General Terms and Conditions
General Terms and Conditions (GTC) — As of April 2026
§ 1 Scope
These General Terms and Conditions apply to all contracts between Oskar Golde / Terra Mia Immobiliare (hereinafter "Operator") and users of the property portal neuruppin.immobilien (hereinafter "Platform"). Deviating conditions of the user are not accepted.
§ 2 Contract Formation
The contract is formed by registering on the platform and selecting a subscription plan. Activation occurs upon successful receipt of payment.
§ 3 Listing Rules
- Listings may only contain real properties that are available at the time of posting.
- False or misleading information is prohibited.
- Discriminatory wording (AGG) is prohibited.
- Advertisers are liable for the accuracy of their information.
- The operator reserves the right to remove listings without prior notice that violate these rules.
§ 4 Obligations of the Advertiser
- Energy Certificate Obligation (GEG § 87): For every residential property listing, the energy certificate type, energy value, and efficiency class must be provided. Violations may result in fines of up to EUR 10,000.
- Price information must comply with the Price Indication Regulation (PAngV) (gross commission).
- The advertiser is obligated to deactivate their listing immediately after rental/sale.
- Contact details must be kept current and accurate.
§ 5 Prices and Payment
Current subscription prices are listed on the <a href="/pricing" class="link link-primary">pricing page</a>. All prices include statutory VAT.
§ 6 Subscription and Contract Term
The following terms apply to all paid products on the neuruppin.immobilien platform — both one-off listings and annual subscriptions.
6.1 Contract Duration
The term depends on the product selected (see 6.4): the rental listing runs for 120 days, the sale listing for 180 days, and the landlord year and agent year for 12 months each. The term begins upon activation (receipt of payment). A shorter term is not available.
6.2 No Automatic Renewal
No product renews automatically once its term expires (in accordance with §309 No. 9 BGB). If you wish to continue using the platform, you must purchase a new listing or subscription.
6.3 Cancellation
You may cancel your subscription at any time via the "Cancel contracts here" button. It is available in the footer of every page, without logging in (§312k BGB). Signed-in users will find the same button in their account as well. The cancellation takes effect immediately, but access to the platform remains until the end of the paid term. No pro-rata refund of fees already paid will be issued.
6.4 Products and Listing Quota
The following products are available:
- Rental listing: 39 EUR (incl. 19% VAT) — 1 listing, 120-day term, one-off purchase
- Landlord year: 99 EUR/year (incl. 19% VAT) — 1 active listing rolling, 12-month term
- Sale listing: 89 EUR (incl. 19% VAT) — 1 listing, 180-day term, one-off purchase
- Agent year: 490 EUR/year (incl. 19% VAT) — unlimited active listings, 12-month term
The quota refers to simultaneously active (publicly visible) listings. Drafts and deactivated listings are not counted.
6.5 Payment Default and Grace Period
In the event of payment default (e.g. failed SEPA direct debit or credit card charge), the operator grants a grace period of 14 days. During this grace period your listings remain publicly visible. After the 14-day grace period expires, all active listings belonging to the user are automatically set to inactive.
6.6 Listings on Expiry of the Term
After the applicable term (see 6.1) and any grace period have expired, all active listings belonging to the user are automatically deactivated (no longer publicly visible). The listing data remains stored in the system and can be reactivated upon purchasing a new listing or subscription.
§ 7 Landlord obligations for applications
When you as a landlord receive applications through the self-disclosure feature, the following additional obligations apply:
- Upon accessing an application, you become an independent controller under GDPR and from that point on bear full responsibility for further processing of the applicant data.
- You commit to not sharing applicant data with third parties — in particular not with other landlords, property managers or credit agencies without separate consent from the applicant.
- At the latest after concluding the rental or after rejection, you must delete applicant data from your own systems. The automatic deletion on neuruppin.immobilien does not relieve you from this obligation.
- neuruppin.immobilien is not liable for landlord GDPR violations from the moment of application access.
§ 7 Limitation of Liability
The operator is not liable for the accuracy of content posted by advertisers. The platform merely provides technical infrastructure for listings. Contracts are concluded exclusively between advertisers and interested parties. The operator's liability is limited to intent and gross negligence.
§ 8 Applicable Law and Jurisdiction
German law applies. The place of jurisdiction is Neuruppin, provided the user is a merchant. For consumers, the statutory jurisdiction rules apply.
